WebNow reserves the right to change these terms and conditions from time to time at its sole discretion. We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Once the service is ordered (i.e. by clicking the order button of the online order form) there are no refunds if the service contract is canceled by client before the regular expiration date / anniversary date.

Any attempt to undermine or cause harm to a server, or customer, of WebNow is strictly prohibited. We reserve the right to remove any host name at any time without any warning in response to abuse of the network. Abuse is defined as anything that is illegal and/or degrades the network such as to affect other users or the network in general.

We feel that spam in any form, including but not limited to, unsolicited commercial email, IRC messages and newsgroup postings is a serious abuse of the network and will not tolerate our name being used in such a way. WebNow takes a zero-tolerance approach to spam originating from our servers or for spam advertising of domains hosted on our servers. The following activities are not allowed:

* Unsolicited bulk or commercial messages ("spam"). This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures, and political or religious tracts. Such messages may only be sent to those who have explicitly requested it from your domain.
* Forging, altering or removing electronic mail headers is prohibited. Any domain sending stealth spam will be terminated without warning and without refund.
* Sending numerous copies of the same or substantially similar message with the intent to disrupt a server or account ("mail bombing").

All hosting accounts may be terminated that include the following content or which have links to the following content:

* Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism or hatred.
* Promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual.
* Acts of copyright infringement including offering pirated computer programs or links to such programs, information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities.
* Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

Backup
While we make every best effort to take server wide backups, the customer is ultimately responsible for their own backups and WebNow shall not be held responsible for any such issues where the backups do not work

Restrictions
Customer shall not receive any credits in connection with any failure or deficiency of Web Site Availability caused by or associated with:

* Circumstances beyond WebNow's reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, virus attacks or hackers, failure of third party software (including, without limitation, ecommerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment
* Failure of access circuits to the WebNow, unless such failure is caused solely by WebNow
* Scheduled maintenance and emergency maintenance and upgrades
* DNS issues outside the direct control of WebNow
* Customer's acts or omissions (or acts or omissions of others engaged or authorized by customer), including, without limitation, custom scripting or coding (e.g., CGI, Perl, HTML, ASP, etc), any negligence, willful misconduct
* E-mail or webmail delivery and transmission;
* DNS (Domain Name Server) Propagation.
* Outages elsewhere on the Internet that hinder access to your account. WebNow is not responsible for browser or DNS caching that may make your site appear inaccessible when others can still access it. WebNow will guarantee only those areas considered under the control of WebNow: WebNow's server links to the Internet, WebNow's routers, and WebNow's servers.
